Privacy Notice
FOMENTO DE CERÁMICA MEXICANA, A.C. (hereinafter "NATIONAL SCHOOL OF CERAMICS and/or ENC"), with its address for purposes of this Privacy Notice at Emiliano Zapata, ext. no. 46 int. 4, La Lagunilla, C.P. 49350, Tapalpa, Jalisco, will be responsible for the personal data provided by individuals (hereinafter the “Data Subject”). In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter "the Law"), we inform you of the following:
The processing of the Data Subject’s personal data will be carried out in accordance with this Privacy Notice, and from this moment it shall be understood that the Data Subject grants consent for the processing of personal data not considered sensitive.
ENC may collect personal identification information through the Data Subject with his/her full consent. Such information may include, but is not limited to: name, email address, home address, telephone number, nationality, date of birth, gender, marital status, CURP (Unique Population Registry Code), company, image, among others.
In the case of job applications, ENC will additionally collect: desired position; availability to relocate and travel; desired income; educational background; languages and proficiency level; professional experience; interests; skills, among others. For billing purposes, ENC will additionally collect: Federal Taxpayers Registry and tax regime.
In the event of being hired under the terms of the Federal Labor Law, ENC will additionally collect: Federal Taxpayers Registry, CURP, social security number, religion, union membership, and basic health information. This is for the purpose of maintaining a complete employment file.
Regarding the processing of data considered sensitive under the Law, the Data Subject hereby grants full consent, without prejudice to exercising “ARCO Rñights” under this Notice.
Other information that may be collected by ENC includes that obtained through:
- Video calls and online conferences.
- Instant messaging on social networks (SMS, WhatsApp, Facebook, Instagram, TikTok, among others).
Likewise, during your visit to this website, ENC may automatically collect the following information regarding your computer and your visit: (i) the domain and server from which you access the Internet, (ii) the Internet address of the website from which you directly linked to our site, if applicable, (iii) the date and time you entered our site, how long you stayed, and which areas you visited, (iv) information about your computer’s operating system version and browser software. We may employ third parties to manage these metrics; however, in no case do we obtain information about the individual identity of any visitor. Such third parties are bound to our privacy standards and will use the collected information only for the purposes for which they were engaged.
During the employment relationship, ENC uses various technological means of internal communication such as video calls or videoconferences, for which the employee grants consent for ENC to use his/her image and voice through photographs and video recordings arising from the Data Subject’s relationship with ENC.
In compliance with Article 14 of the Law, we inform you that the personal data collected by ENC will be managed and processed in accordance with ENC’s general administration and will be used for the following purposes: (i) to identify you; (ii) to locate you; (iii) to communicate with you; (iv) to contact you; (v) to send you information and/or merchandise; (vi) statistical purposes; (vii) to review and respond to your comments; (viii) to send you ENC’s Newsletter; (ix) to inform you about promotions, workshops, and projects; (x) to invite you to participate in ENC’s social networks; (xi) advertising purposes; (xii) compliance with applicable legislation; (xiii) to analyze and respond to job applications; (xiv) compliance with obligations arising from the relationship between the Data Subject and ENC; (xv) compliance with applicable legislation; (xvi) compliance with obligations arising from the relationship between the Data Subject and ENC; (xvii) sending notifications regarding changes to this Privacy Notice.
It is the responsibility of the Data Subject to ensure that the data provided to ENC is truthful and complete, as well as to notify ENC of any modification thereto, in order to comply with the obligation to keep the information up to date.
The information provided to ENC will be duly safeguarded, preserved, and protected with appropriate technological and physical means to prevent its loss, misuse, alteration, unauthorized access, and theft. Only strictly authorized individuals such as employees, affiliates, or subsidiaries will have access to such information.
In the event that the personal data safeguarded is required by an authority of any kind, either due to legal proceedings, to respond to any claim or legal action, or to protect the rights of ENC, its clients, or the public, such data may be made available in strict compliance with the Law.
Data Subjects have the right to request Access, Rectification, Cancellation, or Opposition (ARCO) to the processing of their data, through a written request addressed to the Communications Department at the email address: relaciones.publicas@escuelanacionaldeceramica.org during business hours from 08:00 to 17:00 on business days.
ENC will respond to the Data Subject’s requests, which, in order to be processed, must contain and be accompanied by the following:
- The name of the Data Subject and email address to communicate the response to their request.
- Documents proving the identity of the Data Subject or, where applicable, their legal representation (voter ID, passport, military ID card, or driver’s license).
- A clear and precise description of the personal data regarding which any of the rights are to be exercised.
- Any other element or document that facilitates the location of personal data.
ENC shall have a period of 20 (twenty) business days, counted from the date the request is received or from when the Data Subject resolves the information request, to notify the Data Subject whether or not it is accepted, in accordance with Article 33 of the Law. If the request is accepted, it shall be enforced within the following 15 (fifteen) days. The aforementioned periods may be extended once for an equal period when justified.
Data Subjects have the right to revoke their consent for the processing of their data at any time, by submitting their request in accordance with the procedure outlined above and meeting the specified requirements, so that ENC may carry out the described procedure.
If ENC requires the use of your Personal Data for purposes other than those agreed or consistent with the legal relationship with the Data Subject, notification shall be given in writing, by telephone, electronically, or through any optical, sound, visual, or other means permitted by technology now or in the future, explaining the new uses intended for such information, in order to obtain authorization.
Through this Privacy Notice, Data Subjects are duly informed of the data collected from them and the purposes thereof, accepting the terms drafted in compliance with the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations.
ENC reserves the right to modify this policy to adapt it to legislative or jurisprudential updates, as well as industry practices. In such cases, changes will be announced on this website with reasonable advance notice prior to their implementation.
ENC may amend this Privacy Notice in accordance with reforms and guidelines issued by the Secretariat of Anti-Corruption and Good Governance, which may be reviewed through their publication on the website www.escuelanacionaldeceramica.com
This Privacy Notice, as well as the general handling of the Law by ENC, is governed by the applicable legislation in the United Mexican States, and any dispute arising from its application shall be submitted to the competent courts in Guadalajara, Jalisco.
